These Terms and Conditions ("Terms") govern your access to and use of the website at mentaexperts.com (the "Site"), operated by Menta, a web design and development practice operated by Luis Alfredo Ponce Guevara ("Menta", "we", "us" or "our").

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who we are and how to reach us

Menta provides web design, development and related digital services for businesses. You can contact us at info@mentaexperts.com.

2. Use of the Site

We grant you a limited, non-exclusive, non-transferable and revocable permission to access and use the Site for your own informational and business purposes, subject to these Terms.

• Use the Site in any way that breaks an applicable law or regulation.

3. Inquiries and form submissions

The Site includes a form you can use to send us an inquiry or request a proposal.

By submitting the form, you confirm that the information you provide is accurate and that you are authorized to share it. Sending an inquiry does not create any contract for services between you and Menta, and any proposal we send is not binding until both parties sign a separate written agreement.

Information you submit through the form is not treated as confidential by the mere act of submission. Please do not send us confidential or sensitive information through the form unless we have agreed in writing on how it will be handled.

4. Intellectual property

All content on the Site, including text, graphics, logos, images, layouts, design, code and the selection and arrangement of that content, is owned by Menta or its licensors and is protected by intellectual property laws.

The name "Menta", the Menta logo and any related marks are the property of Menta. Nothing on the Site grants you any right or license to use them without our prior written permission.

You may view and print Site content for your own reference. Any other use, including reproduction, modification, distribution or commercial exploitation, requires our prior written consent.

5. Services

The Site describes the services Menta offers. Any content on the Site is provided for general information and is not an offer that can be accepted to form a contract. All work is governed by a separate written agreement or proposal that sets out the specific scope, deliverables, fees and terms agreed between Menta and the client.

The Site may contain links to third-party websites or use third-party tools. We provide these for convenience and do not control or endorse them. We are not responsible for the content, policies or practices of any third party. Your use of any third-party site or service is at your own risk and subject to that third party's terms.

To the extent any liability cannot be excluded, our total liability arising out of or in connection with the Site is limited to the amount you have paid us, if any, for access to the Site, which for a freely accessible site is zero.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

You agree to indemnify and hold Menta harmless from any claims, losses, liabilities and expenses, including reasonable legal fees, arising from your misuse of the Site or your breach of these Terms, to the extent permitted by law.

Your use of the Site is also governed by our Privacy Policy, which explains how we handle personal data. By using the Site, you acknowledge that you have read it.

11. Changes to the Site and to these Terms

We may change, suspend or discontinue any part of the Site at any time. We may also update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Your continued use of the Site after changes take effect means you accept the revised Terms.

12. Governing law

These Terms are governed by the laws of Ecuador, where Menta operates, without regard to conflict of law rules. The courts located in Quito will have jurisdiction over any dispute arising out of or in connection with these Terms or the Site, subject to any mandatory consumer protection rights you may have in your country of residence.

13. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our consent. We may assign them in connection with a transfer of our business. These Terms, together with the Privacy Policy, make up the entire agreement between you and Menta regarding your use of the Site.
